What happened to cause a data breach at Hockley Medical Practice?
A cyber attack has meant that the medical data of thousands of patients could have been accessed at the Hockley Medical Practice. After the breach was discovered, the GP practice contacted all adult patients to inform them that their medical records may have been hacked.
Staff at the Birmingham-based Hockley Medical Practice, based in the Jewellery Quarter, responded after being made aware of the possible cyber attack and under the GDPR were obligated to inform patients that they may have breached their patient data. The Information Commissioner’s Office were, as required, also informed of the breach.
Some patients are reported to have received phishing emails, purportedly from the NHS, which contained some of their personal details and were clearly attempts to get more information from them by requesting they click on questionable links. Warnings were provided to patients from the NHS Sandwell and West Birmingham Clinical Commissioning Group, advising that people should never provide financial details, pins or passwords via email, and that they shouldn’t click on any links in suspicious emails they may receive.
Details of the sensitive personal information accessed by the hack have not been fully disclosed, but anyone affected could potentially claim under the General Data Protection Regulation for compensation for inconvenience, distress, annoyance and loss of control of your data.

Can I make a Hockley Medical Practice data breach claim?
If you’ve been a victim of a data breach then yes, it is likely you can make a claim. Usually you will have been informed by the business or organisation, possibly by email, that there has been a data breach.
In other instances there may be a group litigation claim whereby a large number of customers can be part of a collective claim, for example when a data breach occurs between a set time period. If you were a customer during this time, then it is quite possible that you have been affected by the data breach.
If you have been a victim of a data breach then you may be entitled to compensation. Even if the breach has not led to any specific loss to you, you are still entitled to claim compensation for distress and inconvenience caused by a data breach.

Commonly asked questions
An organisation is required under GDPR to inform you if they have breached your personal data in any way, and typically the first you might hear about it would be an email from the company concerned. Despite this, you may not know about a data breach by a particular company until you hear that they have been fined by the Information Commissioner’s Office ICO. When you contact us, we’ll get in touch with the company in question and use any information available from the ICO to establish whether your data has been breached.
If an organisation has failed to protect your data, you are entitled to claim compensation regardless of whether you have suffered any losses or not. We can make a claim on your behalf for anguish or anxiety caused by a data breach, but if you have suffered financial harm as a direct result of the breach, the amount of compensation you might be able to claim would likely be far greater.
Each data breach claim will be looked at on its own merits, but in most cases where a claim for distress has been made, the minimum level of damages would usually be in the region of a £1,000. Much depends on the circumstances of the breach and any impact. Where the data breach has caused significant financial loss or the leak of highly sensitive personal data, then the level of compensation could be significantly higher.
We work on a No Win, No Fee basis, so this means that if your claim is not successful, you will not owe us a thing. Only in the event of a successful compensation claim would you be required to pay us a percentage of your settlement, so there is absolutely no risk involved in making a data breach claim.
