What happened to cause a Virgin Media Data Breach?

Personal information stored on one of Virgin Media’s databases was accessed without permission. The incident did not occur due to a hack but as a result of the database being incorrectly configured, leaving it unsecured and accessible for 10 months from April 2019.

The database was used to manage information about existing and potential customers in relation to the company’s marketing activities and included details such as:

  • contact details (name, home and email address and phone numbers)
  • technical and product information
  • details of any requests made via forms on the website
  • date of birth (in small number of cases)

The information is known to have been accessed on at least one occasion by an unknown person. It did not include passwords or financial details, such as bank account numbers or credit card details.

The majority of those affected by the data breach affected were Virgin customers with television or fixed-line telephone accounts, although some Virgin Mobile customers as well as potential customers referred by friends as part of a promotion were also included in the database that was accessed. Anyone affected could claim for undue financial and emotional distress.

Commonly asked questions

An organisation is required under GDPR to inform you if they have breached your personal data in any way, and typically the first you might hear about it would be an email from the company concerned. Despite this, you may not know about a data breach by a particular company until you hear that they have been fined by the Information Commissioner’s Office ICO. When you contact us, we’ll get in touch with the company in question and use any information available from the ICO to establish whether your data has been breached.

If an organisation has failed to protect your data, you are entitled to claim compensation regardless of whether you have suffered any losses or not. We can make a claim on your behalf for anguish or anxiety caused by a data breach, but if you have suffered financial harm as a direct result of the breach, the amount of compensation you might be able to claim would likely be far greater.

Each data breach claim will be looked at on its own merits, but in most cases where a claim for distress has been made, the minimum level of damages would usually be in the region of a £1,000. Much depends on the circumstances of the breach and any impact. Where the data breach has caused significant financial loss or the leak of highly sensitive personal data, then the level of compensation could be significantly higher.

We work on a No Win, No Fee basis, so this means that if your claim is not successful, you will not owe us a thing. Only in the event of a successful compensation claim would you be required to pay us a percentage of your settlement, so there is absolutely no risk involved in making a data breach claim.
